The text below constitutes an agreement between the online store, whose website is located on the Internet at https://polyatskiy.com.ua, hereinafter referred to as the “Online Store”, and the user of the Online Store services, hereinafter referred to as the “Buyer”, and defines the terms and conditions for the purchase and sale of goods by the Buyer through the website of the sole proprietor FOP Khorolska D. A..
1. General Provisions
1.1. This agreement is a public offer agreement (in accordance with Articles 633, 641 and Chapter 63 of the Civil Code of Ukraine), and its terms are одинакові for all Buyers regardless of status (individual, legal entity, individual entrepreneur).
1.2. In the event of acceptance of the terms of this agreement, i.e., the public offer of the Online Store, the user becomes a Buyer.
2. Terms and Definitions
2.1. Online Store – Polyatskiy, established in accordance with the legislation of Ukraine, operating a website located on the Internet at https://polyatskiy.com.ua
2.2. Product – a list of goods published on the Online Store website.
2.3. Buyer – an individual who has reached the age of eighteen, who receives information from the Online Store, places an order for the purchase of Products presented on the website of the Online Store for purposes not related to entrepreneurial activity, or a legal entity / individual entrepreneur.
2.4. Order – a completed and submitted request of the Buyer addressed to the Online Store for the purchase of goods.
2.5. Website – a set of pages accessible via a web browser and software modules united by a single management system, located on the Internet at https://polyatskiy.com.ua/, and containing all the features of a public offer for the sale of Products selected by the Buyer on the website.
2.8. Personal Account – a space on the Website accessible to the Buyer, where their personal information and the history of their Orders are displayed.
3. Subject of the Agreement
3.1. This agreement defines the procedure of interaction and the conditions for the provision of services by the Online Store to the Buyer, based on the Buyer’s intention, desire and ability to use the services for purchasing Products, as well as on the Online Store’s intention to provide the Buyer with the necessary information, sell and комплектувати Products in accordance with the Buyer’s Order.
3.2. The Online Store provides the Buyer with the following services:
3.2.1. Sale of Products based on an Order placed by the Buyer on the Website and confirmed by the Online Store.
3.3. The Online Store sells and delivers Products using courier delivery services specified on the website, based on Buyers’ requests placed on the Website and confirmed by the Online Store. The prices indicated on the Website include the cost of the Product, unless otherwise specified in the Order confirmation. The cost of delivery (transportation) is paid additionally by the Buyer.
3.4. The Buyer agrees to the terms of this agreement at the moment of placing an Order by clicking the “Confirm Order” button, which expresses the Buyer’s confirmation that they have read the text of this agreement and agree to its terms. Any further objections by the Buyer regarding such consent release the Online Store from any liability for failure to fulfill the terms of this agreement and grant the Online Store the right to cancel the Order unilaterally.
4. Rules for Using the Website
4.1. The Buyer may view the content of the Website, place orders, and use other services.
4.2. Registration is required for the Buyer to access personalized information and additional Website features.
4.3. During registration, the Buyer provides the following data:
- First name, last name
- Email address
- Password
4.4. The Buyer undertakes to provide accurate, complete, and up-to-date information. The Online Store is not responsible for the accuracy of the information provided by the Buyer during registration and order placement.
4.5. After registration, the Buyer is granted access to the Personal Account.
4.6. The Buyer undertakes not to disclose login credentials to third parties. In case of suspicion of unauthorized use, the Buyer must immediately notify the Online Store by phone: +38 075 902 88 42
4.7. The Buyer is responsible for all actions performed on the Website under their account.
4.8. The Online Store has the right to deny services if it has grounds to believe that the Buyer has provided false information or behaves improperly (e.g., violation of this agreement).
4.9. It is prohibited to use the Website for illegal or prohibited activities. Buyers agree to comply with Ukrainian law and accepted Internet norms, including but not limited to posting extremist, pornographic, or other materials that violate honor, dignity, or business reputation of third parties.
5. Order Placement and Delivery
5.1. The Buyer places an Order independently by adding Products to the cart and clicking “Place Order”.
5.2. Orders can be placed without registration.
5.3. The total delivery period includes order processing, production, and delivery time. Processing time is from one to three business days. Delivery methods are described in the “Payment & Delivery” section. Delivery time depends on location, delivery method, and product availability.
5.4. For wholesale orders, terms are agreed individually.
5.5. The Online Store is not responsible for delivery time as it depends on third parties (carriers).
6. Payment Procedure
6.1. The Buyer selects Products and pays under the conditions agreed in the confirmed Order.
Payment is made using convenient methods listed in the “Payment & Delivery” section.
After placing an Order, a manager will contact the Buyer to confirm details.
6.2. The total Order cost includes the full cost of Products and services and is indicated at checkout. Delivery cost is paid additionally.
7. Return Policy
7.1. An individual Buyer may refuse defective goods within 14 days, provided packaging, condition, and documents are preserved. Legal entities/entrepreneurs may request warranty repair. If damage is not caused by the Online Store, return/exchange may be refused.
7.2. If the Buyer refuses the parcel, it is returned to the Online Store. Return shipping is paid by the Buyer. Refunds may be reduced by incurred costs.
8. Privacy and Data Protection
8.1. The Buyer provides personal data during registration.
8.2. By providing data, the Buyer consents to processing under Ukrainian law.
8.3. Data is used to provide services and marketing.
8.4. The Online Store does not disclose data except as required.
8.5. The Buyer may request deletion but will lose access.
8.6. The Buyer is responsible for data accuracy.
9. Notifications
9.1. The Buyer agrees to receive messages via SMS and email.
9.2. The Buyer may unsubscribe at any time.
10. Use of Website Materials
10.1. The Website contains protected materials.
10.2. Content is protected by Ukrainian law.
10.3. Unauthorized use is prohibited.
11. Other Conditions
11.1. The agreement is governed by Ukrainian law.
11.2. Invalid provisions do not invalidate the entire agreement.
11.3. Disputes are resolved through negotiation or court.
11.4. The Online Store may modify the agreement at any time without notice. The current version is always available on the Website.
